মূলভাব : বিচারকের কাজ অপরাধীর শাস্তি বিধান করা। কিন্তু প্রকৃত বিচারক সে ব্যক্তি যে অপরাধীকে শাস্তি দিতে গিয়ে তার প্রতি সমবেদনা প্রকাশ করেন।
সম্প্রসারিত ভাব : ন্যায়-অন্যায় নিয়েই আমাদের কর্মজীবন। ন্যায়-নিষ্ঠ সর্বত্র সাধুবাদ পেয়ে থাকে। পক্ষান্তরে, অন্যায়কারী হয় দণ্ডিত। কিন্তু বিচারের মাধ্যমে অপরাধীকে বুঝিয়ে দিতে হয় অপরাধ নিন্দনীয়। ন্যায় বিচার ঘৃণা করে পাপকে, পাপীকে নয়। বিচারকের জন্য সে কথাই প্রযোজ্য। প্রকৃত বিচারক সমদর্শী, ন্যায় ও সত্যের জীবন্ত বিগ্রহ। তিনি সত্যের পথ থেকে বিচ্যুত হন না। তাঁর কাজ বড় দায়িত্বপূর্ণ। ন্যায় ও সত্যের মর্যাদা রক্ষার জন্য তিনি অপরাধীকে দণ্ডের আদেশ প্রদান করেন বটে, কিন্তু সংবেদনশীল মানুষ হিসেবে দণ্ডাদেশ উচ্চারণ করতে তিনি দণ্ডিতের জন্য দুঃখ অনুভব করেন। তিনি মনে করেন, দণ্ডিত ব্যক্তি তারই মত একজন মানুষ। কোন মানুষই অপরাধী হয়ে জন্মেনি। জন্মানোর পরই সে অপরাধ করে। হয়ত রিপুর তাড়নায় অথবা লোভের বশবর্তী হয়েই সে এ কাজ করে। ব্যক্তি মানুষের অপরাধ প্রবণতার পেছনে কেবল যে ব্যক্তি নিজে দায়ী থাকে তা নয়, অনেক সময় পরোক্ষভাবে সমাজও তাকে অপরাধপ্রবণ করে তোলে। তাই যে বিচারক অপরাধীকে দণ্ড দিতে গিয়ে তার প্রতি সমবেদনা প্রকাশ করেন এবং নিজেকে দণ্ডিত ব্যক্তি বলে ব্যথিত হন তাঁর বিচারই হবে সর্বশ্রেষ্ঠ বিচার। অর্থাৎ নিরপেক্ষতার সাথে সহানুভূতির মাত্রা যোগ হলেই বিচার মানবিক রূপ পায়, এর শ্রেষ্ঠত্ব তখনই ।
মন্তব্য : যে বিচারক দণ্ডিতের ব্যথায় ব্যথিত হন, তিনিই প্রকৃত বিচারক। আর তাঁর কাছ থেকেই ন্যায় বিচার প্রত্যাশা করা যেতে পারে।
